Occupational Accident
Insurance Stand Alone Program: |

High Point offers Occupational Accident on a
standalone basis, but prefers only to offer this option to those
companies who are already established with "qualified" Self Insured
status in the states in which they operate. Those companies who are
self insured are already allowed by state law to respond with
statutory coverage payable out of their self insured retention
accounts. By making available occupational accident, the Company
provides the independent contractor with a benefits program that
will extend coverage to on-the-job injuries and provide a degree of
financial protection for the independent contractor and their
families. However, if the driver seeks reclassification, then
defending this challenge and responding with statutory benefits paid
via their corporate self-insured program allows the company the
ability to respond to the reclassification claim properly under
statutory guidelines with minimal exposure to additional premium
audits from their excess workers compensation insurer.

Occupational Accident with
"If Any" Workers' Compensation Program: |
|
Qualifying for self insured status is very
difficult and expensive to undertake as an option. Thus, most
trucking companies need to secure an Occupational Accident program
that will also extend a workers' compensation component of coverage.
High Point offers TWO such programs. The standard Occupational
Accident and Individual Driver "If Any" Workers' Compensation
Program AND the "Total Risk Management Solution" offered through
Contractor Resource Solutions.
The standard Occupational Accident and "If
Any" Workers' Compensation program combines an occupational accident
policy sold in conjunction with a workers compensation plan of
insurance that is issued in the name of the owner operator
independent contractor driver with the driver formally exempting
themselves as a Sole Proprietor / Self Employed person. High Point
names the participating Company as the Alternate Employer under an
Alternate Employer Endorsement issued with the policy.
In the event the exempted driver files for
reclassification as an employee, then the defense position of the
drivers' exemption as a Sole Proprietor along with the contract
position is used to defend the reclassification action. If the
driver wins reclassification as an employee, then statutory coverage
is provided to the reclassified employee driver for the Motor
Carrier via the Alternate Employer Endorsement coverage position.
This program option provides the company
with Workers Compensation coverage certificates for each driver that
are maintained in the driver files in the event of an audit. This
program structure provides an established coverage position for
statutory benefits under the Alternate Employer Endorsement and
provides legally recognized evidence of coverage in the event a
workers compensation audit is brought by either the State or by the
corporate workers compensation insurance carrier.
This program option can also be offered to companies utilizing
independent contractor drivers who also have the exposure for casual
laborer helpers. This is prevalent in the Moving and Storage as well
as the Home Delivery industries.
