This is an occupational/accident policy with “contingent
liability”. In order to affect this coverage, the Motor
Carrier, has his owner/operator(s) approach CRS and sign up with
them. CRS holds the O/Os contract with the MC. CRS receives the
settlement check from the MC and distributes it to the O/O. CRS,
has with the insurance carrier, that is providing the occupational/accident
policy an “if any” worker’s compensation policy
listing the transportation codes. Because of this arrangement
CRS can provide a Statutory WC certificate to the MC and thus
eliminates the MCs owner/operators from his WC audit potential.
In the event that the owner/operator sues for employee status
and prevails the O/O becomes an employee of CRS not the MC. |
